<p><span style="font-size:medium;"><i><b>On January 8, 2013, the Illinois House passed SB 957, which enables undocumented immigrants in Illinois to get temporary visitor driver’s licenses (TVDLs). The bill now goes to Governor Quinn, who has supported the bill and said he will sign it. When that happens, Illinois will become the fourth state (and first new state since 2003) to authorize undocumented immigrants to drive legally.</b></i></span></p>
<p><span style="font-size:medium;"><b>What is a Temporary Visitor Driver’s Licenses (TVDL)?</b></span></p>
<p><span style="font-size:medium;">The TVDL is an existing document that is now available to many foreign-born individuals living in Illinois. Since 2005, Illinois has issued TVDLs to individuals who do not have SSNs but who have lawful immigration status. Such individuals include foreign students, spouses and children of temporary workers, long-term visitors, and others who are not authorized to work under our immigration laws. Many of these individuals still need to drive on a regular basis to get to classes, shop, take their children to school, or attend to other family and personal business. <i><b>SB 957 makes TVDLs available to undocumented motorists who also need to drive for these purposes.</b></i></span></p>
<p><span style="font-size:medium;">TVDLs are <i><b>visually distinct</b></i> from regular licenses: TVDLs current use a purple color scheme, as opposed to the red scheme used for regular licenses. TVDLs are also clearly marked as “<i><b>not valid for identification</b></i>.” </span></p>

<p><span style="font-size:medium;"><b>Why TVDLs instead of regular licenses?</b></span></p>
<p><span style="font-size:medium;">The federal REAL ID Act requires that states can issue regular driver’s licenses only to those individuals with lawful immigration status. Because they are visually distinct from regular licenses and are marked as not valid for identification, TVDLs already comply with REAL ID while still enabling undocumented immigrants to drive legally.</span></p>
<p><span style="font-size:medium;"><b>What requirements will applicants need to meet to get a TVDL? </b></span></p>
<p><span style="font-size:medium;">To qualify for a TVDL, an undocumented immigrant must </span></p>
<ul>
<li><span style="font-size:medium;">Prove that she has lived in Illinois for at least one year;</span></li>
<li><span style="font-size:medium;">Provide a valid unexpired passport or consular ID;</span></li>
<li><span style="font-size:medium;">Provide other proof of her identity and residency that the Secretary of State might require;</span></li>
<li><span style="font-size:medium;">Provide documentation that she is not eligible for a Social Security Number;</span></li>
<li><span style="font-size:medium;">Pass all applicable vision, written, and road tests; </span></li>
<li><span style="font-size:medium;">Show proof of insurance for the vehicle she uses for the road test;</span></li>
<li><span style="font-size:medium;">Pay a $30 fee.</span></li>
</ul>
<p><span style="font-size:medium;"><b>When will TVDLs become available?</b></span></p>
<p><span style="font-size:medium;">This new law will take effect ten months after Governor Quinn signs it—that is, sometime in fall 2013.</span></p>
<p><span style="font-size:medium;"><b>Where will applicants be able to apply?</b></span></p>
<p><span style="font-size:medium;">The Secretary of State intends to make TVDL applications available at most of its facilities. (Currently TVDLs are available at only certain facilities.) </span></p>
<p><span style="font-size:medium;"><b>Will applicants get a TVDL the same day as they apply?</b></span></p>
<p><span style="font-size:medium;">No. The Secretary of State will need to review and verify the documents that get submitted with the application. SoS will then issue the TVDL from a central facility and send it to the applicant by mail.</span></p>
<p><span style="font-size:medium;"><b>Will the Secretary of State have enough resources to implement this law?</b></span></p>
<p><span style="font-size:medium;">The Secretary of State estimates that its first-year costs to implement TVDLs would be approximately $800,000. SoS will therefore have enough money to pay for TVDLs if as few as 30,000 individuals apply (out of potentially 250,000), each paying $30 each. </span></p>
<p><span style="font-size:medium;"><b>Is the TVDL valid as proof of identity?</b></span></p>
<p><span style="font-size:medium;">No—and as a result, the TVDL cannot be used for voting, getting a firearms identification card, boarding an airplane, or entering a federal building. However, hospitals, first responders, and others could still use the TVDL as a document to <i>indicate</i> the person’s name and address. TVDL holders could still provide passports and consular identification cards as proof of identity.</span></p>
<p><span style="font-size:medium;"><b>Could the TVDL be used as a bond card?</b></span></p>
<p><span style="font-size:medium;">Yes. Drivers with TVDLs can produce the card as bond during a traffic stop, just as drivers with regular licenses can. They would get ticketed rather than being arrested (because they cannot produce bond) and ending up in the criminal justice and immigration enforcement pipeline. Police time and jail space will no longer be taken up with so many motorists who are arrested for driving without a license.</span></p>
<p><span style="font-size:medium;"><b>What happens if someone with a TVDL drives without insurance?</b></span></p>
<p><span style="font-size:medium;">TVDL holders will be subject to all provisions of the Vehicle Code, including those requiring insurance coverage. In fact, anyone applying for any license, including a TVDL, must prove that the vehicle she is using for her road test is insured. Finally, if someone with a TVDL is stopped and cannot show proof of insurance, the TVDL becomes invalid, and the motorist can be ticketed for driving without a license.</span></p>
<p><span style="font-size:medium;"><b>If someone with a TVDL is stopped, will law enforcement know that the person is undocumented? </b></span></p>
<p><span style="font-size:medium;">TVDLs will be available to both visa holders and undocumented immigrants, so law enforcement officers cannot assume that anyone with a TVDL is undocumented. </span></p>
<p><span style="font-size:medium;"><b>Does the TVDL grant any status to undocumented immigrants?</b></span></p>
<p><span style="font-size:medium;">Immigration status is a matter of federal law. TVDLs issued under state law cannot convey any immigration status. TVDLs would do nothing more than enable undocumented immigrants to comply with our state’s traffic laws.</span></p>

<p lang="es-MX" align="JUSTIFY"><em><strong>El 8 de enero del 2013, la Casa de Representantes de Illinois pasó la ley SB 957, la cual permite a los inmigrantes indocumentados en Illinois, obtener una licencia de conducir para visitantes temporales, por sus siglas en inglés (TVDLs). Esta legislación ahora va al escritorio del Gobernador Quinn, quien ha apoyado esta ley y ha dicho que la firmará. Cuando esto suceda, Illinois se convertirá en el cuarto estado (y primero desde 2003) en autorizar a los inmigrantes indocumentados manejar legalmente.</strong></em></p>

<p lang="es-MX"><strong>¿Qué es una licencia de conducir para visitantes temporales (TVDL)?</strong></p>
<p lang="es-MX" align="JUSTIFY">La licencia de conducir para visitantes temporales es un documento que ya existe y está disponible para muchos de los individuos que viven en Illinois y que nacieron fuera de los Estados Unidos. Desde el 2005, Illinois ha emitido esta licencia de conducir para visitantes temporales a individuos que no tienen número de seguro social, pero que tienen un estatus migratorio legal. <p lang="es-MX"><strong>¿Por qué licencias de conducir para visitantes temporales y no licencias regulares?</strong></p>
<p lang="es-MX" align="JUSTIFY">El acuerdo federal REAL ID requiere que los estados puedan emitir licencias de conducir regulares sólo a aquellos individuos con un estado migratorio legal. Como estos son visualmente diferentes a las licencias regulares y son marcados como documento no válido como una identificación, las licencias de conducir para visitantes temporales cumplen así con este acuerdo de REAL ID a la vez que permiten a los inmigrantes indocumentados conducir legalmente.</p>
<p lang="es-MX">
<p lang="es-MX"><strong>¿Qué requerimientos necesitarán quienes apliquen para obtener las licencias de conducir para visitantes temporales (TVDL)? </strong>Para calificar para TVDL, un inmigrante indocumentado debe:</p>
<ul>
<li>
<p lang="es-MX">Demostrar que ha vivido en Illinois durante al menos un año;</p>
</li>
<li>
<p lang="es-MX">Proporcionar un pasaporte válido, es decir, que no esté vencido y una matrícula consular vigente;</p>
</li>
<li>
<p lang="es-MX">Proveer otra prueba de identificación y de residencia que la Secretaria del Estado podría requerir;</p>
</li>
<li>
<p lang="es-MX">Proveer documentos que comprueben que no pueden ser elegibles para un número de seguro social;</p>
</li>
<li>
<p lang="es-MX">Pasar todos las pruebas que aplican como, visión, escrita y de manejo;</p>
</li>
<li>
<p lang="es-MX">Enseñar comprobante del seguro del vehículo que utilice para la prueba de manejo;</p>

Los conductores con este tipo de licencias de conducir para visitantes temporales pueden producir la tarjeta como la fianza durante una parada de tráfico, como lo hacen los conductores con licencias regulares. Actualmente, en una parada de tráfico, conductores indocumentados son detenidos y terminan en el mismo sistema de justicia criminal y de leyes de migración, con un TVDL el conductor podrá usar este TVDL como fianza por su multa y no serán detenidos. El tiempo de la policía y el espacio de cárcel ya no serán afectados con tanto conductor que es arrestado por manejar sin una licencia.</p>
<p lang="es-MX">
<p lang="es-MX"><strong>¿Qué pasa si alguien con una licencia de conducir para visitante temporal maneja sin el seguro?</strong></p>
<p lang="es-MX" align="JUSTIFY">Los conductores con licencias de conducir para visitantes temporales serán sujetos a todas las provisiones del Código de Vehículo, incluso los requerimientos de la cobertura de seguros. De hecho, alguien solicitando cualquier licencia, incluso una licencia de conducir para visitante temporal, debe demostrar que el vehículo que utiliza en su prueba de manejo está asegurado. Finalmente, si alguien con una licencia de conducir para visitante temporal es parado y no puede mostrar la prueba del seguro, esta licencia ya no será válida, y el conductor podría ser multado por conducir sin una licencia.</p>

<p lang="es-MX"><strong>¿Si alguien con una licencia de conducir para visitante temporal es parado, van a saber los policías que esta persona es indocumentada?</strong></p>
<p lang="es-MX" align="JUSTIFY">Las licencias de conducir para visitantes temporales estarán disponibles, tanto para los inmigrantes con visa, como para los indocumentados, así que los oficiales no pueden asumir que todos los que poseen una licencia de conducir para visitantes temporales son indocumentados.</p>

<p lang="es-MX" align="JUSTIFY"><strong>¿Otorga esta licencia de conducir para visitante temporal algún tipo de estatus para inmigrantes indocumentados?</strong></p>
<p lang="es-MX" align="JUSTIFY">El estatus migratorio es un asunto de la ley federal. Las licencias de conducir para visitantes temporales se emiten bajo la ley estatal y no puede dar ningún estatus migratorio. Las licencias de conducir para visitantes temporales no harán nada más que permitir a los inmigrantes indocumentados cumplir con las leyes de tráfico de nuestro estado de Illinois.</p>

<p>This nation is a melting pot of immigrants, both legal and not. Our state is no different.</p>
<p>We celebrate the ethnic diversity of our population and welcome those who come to this country and pursue citizenship, and whose work and effort have helped make this country great.</p>
<p>We also have a continuing concern with the numbers of immigrants in this country who are here without any legal authority. Many of them have come to America from our southern neighbor seeking work and a better life for their families. Another large percentage of the undocumented immigrants came to our country legally from probably every country on earth and have overstayed their visas.</p>
<p>The question of immigration reform is an emotional one, and one in which the federal government must play the lead role. It is a national concern, and yet it is also an issue in the 50 states individually.</p>
<p>As a nation, we must secure our borders, and we must provide a wider door to citizenship to those who come to our country legally. As a state, we must also recognize the impact of an estimated 250,000 undocumented immigrant drivers on Illinois’ streets and highways and on the cost of car insurance to family budgets.</p>
<p>There is a cost to society when we have uninsured, untrained, untested, drivers. With the recent legislation to extend the current Illinois temporary visitors driver’s licenses to the undocumented immigration population, Illinois is offering another response to the lack of action from the federal government over the last decade or more.</p>
<p>It doesn’t allow the license holder to use that license as identification to register to vote, to board an airplane or to purchase a firearm. It requires undocumented immigrants to prove their identity, be tested and purchase insurance to drive legally on our streets and highways.</p>
<p>As a legislator, I’ve supported other Illinois responses to what is a national immigration question. I have opposed this specific kind of legislation in the past. Because of agreement with the statutory language I proposed that would prevent the use of the temporary visitors driver’s licenses for identification, I believe this specific bill is in the best interests of Illinois citizens.</p>
<p>Untested, uninsured immigrants are driving today. Those drivers cost $64 million annually in uninsured damage claims that other policy holders must cover. In 2011, 42 percent of all fatal crashes in Illinois involved an unlicensed driver. In Lake County, 28 percent of all motorists booked for traffic offenses in the last year were undocumented immigrants who could not get licenses, burdening our public safety system.</p>
<p>Our goal is not to encourage more illegal immigration to Illinois. Instead, it is to promote safe driving and to unburden licensed motorists from the financial cost to them resulting from a collision with an uninsured motorist.</p>
<p>Testing, training, licensing and insuring undocumented immigrants will lead to improved highway safety, save lives and ultimately lower vehicle insurance rates for Illinois motorists.</p>

<p>If people need to drive but can’t legally obtain proper documentation, they’ll often resort to illegal methods.</p>
<p>A story in Monday’s Sun-Times by Frank Main reported that thousands of immigrants are suspected of obtaining driver’s licenses through a Chinatown fraud ring between 2003 and 2008. Many of those immigrants faked the written test and didn’t even take the road test, says the FBI.</p>
<p>The danger here is clear and present: Drivers who don’t have to pass any test and who aren’t allowed to buy insurance are a threat to everyone else on the highway.</p>
<p>Legislation already passed by the state Senate and pending in the House — with Republican leadership support — would offer an alternative for the tens of thousands of illegal immigrants believed to be driving on Illinois roads. The House should pass the bill and send it to Gov. Pat Quinn, who has said he will sign it.</p>
<p>The bill would allow illegal immigrants to get temporary visitor driver’s licenses, which already are available for foreign students, spouses and children of temporary workers, long-term workers and others who are here legally but don’t have the Social Security numbers needed to obtain a regular driver’s license. The IDs are similar to regular driver’s licenses but have purple backgrounds instead of red.</p>
<p>Opponents of the measure say it sends the wrong message to reward people who have broken immigration laws.</p>
<p>But if the legislation encourages illegal immigrants to undergo driver training so they can pass the same vision, written and road tests as anyone else, that would make Illinois’ roads safer. And it would also allow the immigrants to buy insurance.</p>
<p>Illegal immigrants with the licenses would have less reason to leave the scene of an accident. Health-care providers could more easily ID patients. Fewer people would be deported after a routine traffic stop.</p>
<p>This bill deserves a green light.</p></blockquote>

<p align="center"><i>ICIRR Statement responds to Chicago Sun-Times “</i>Chinatown license fraud ring put dangerous drivers on the street” story December 10, 2012</p>
<p>In response to today’s Chicago Sun Times article <i><a href="http://www.suntimes.com/16546323-761/fake-passports-phony-licenses-chinatown-fraud-ring-put-dangerous-drivers-on-the-street.html" target="_blank">“Chinatown license fraud ring put dangerous drivers on the street</a>,</i>” the Illinois Coalition for Immigrant and Refugee Rights has issued this statement:</p>
<p>Today’s Chicago Sun Times carries a story that highlights the document fraud and dangers to Illinois drivers that result from the current lack of an avenue of a legal system through which undocumented immigrants can obtain legal driving documents. The Illinois Coalition for Immigrant and Refugee Rights (ICIRR) unequivocally condemns the use of fraudulent documents, including those uncovered by Operation Paper Mountain, a federal investigation of a fake document ring that was cracked in 2008.</p>
<p>The Highway Safety Legislation that we support, SB 957, is an especially important and relevant piece of legislation because it will protect both our roads and the rule of law. Under our current system undocumented immigrants who would like to obtain legal driving privileges cannot do so. The Sun-Times story shows that this creates a lucrative black market for fraudulent documents, corruption in the Secretary of State’s office, and results in large numbers of unlicensed or fraudulently licensed and uninsured drivers sharing our roads.</p>
<p>The reality is that Illinois is home to approximately 250,000 immigrant motorists who are unable to get a driver’s license and insurance.  SB 957 would make Temporary Visitor Driver’s Licenses (TVDL) available to these motorists who also need to drive and provides a concrete solution to the problem of document fraud by drying up the black market for expensive fraudulent documents.  Encouraging these motorists to get tested and insured is a better solution than allowing people to drive on our roads without the proper requirements.  Data from other states that have similar programs demonstrates that immigrant motorists, if allowed, do in fact apply for licenses and insurance.</p>
<p>TVDL is a driving card and its sole purpose is to prove that the person behind the wheel has been trained, tested, licensed and insured. The TVDL contains many security and anti-fraud guarantees.</p>
<ul>
<li>The TVDL is visually distinct, and states on the License that it cannot be used for purposes other than driving. Therefore it cannot be used to board a plane, purchase a firearm, enter a federal building or vote.</li>
</ul>
<ul>
<li>The TVDL applicants will undergo a biometric identity check and;</li>
</ul>
<ul>
<li>All TVDL applicants will need to provide a valid current <b><i>passport or consular ID</i></b> document.  Foreign governments already establish strong procedures for issuing these documents for verifying those that get issued.  These governments have no interest in enabling fraud.</li>
</ul>
<ul>
<li>The Secretary of State photographs all applicants for any license, and uses <b><i>facial recognition</i></b> software to prevent duplicate identities.</li>
<li>All applicants must show they have <b><i>lived in Illinois for at least one year</i></b>, so people would not be able to claim bogus addresses in Illinois to get a TVDL.</li>
<li>The Secretary of State (SoS) will also process applications at a <b><i>central location in order to verify documents</i></b>.  No one will be issued a TVDL on the same day; SoS will check the applicant’s documents and, if they are legitimate and meet all standards, SoS will send the TVDL to the applicant by mail.</li>
<li>Finally, the Secretary of State will have the authority to set further standards for which documents he will accept.</li>
</ul>
<p>The ICIRR along with the Highway Safety Coalition will continue to work with legislators and the Secretary of State to ensure that anti-fraud measures are fully implemented.</p>
<p>Temporary Visitor’s Drivers Licenses are a solution to the type of document fraud that took place in Chinatown between 2002 and 2008. We look forward to passing this legislation in the House of Representatives in early January.</p>

<p>Today Latino community leaders and members of <a href="http://highwaysafetycoalition.org/" target="_blank">The Highway Safety Coalition</a> thanked and honored Senate President John Cullerton for his leadership in passing the highway safety legislation, SB 957 with historic bipartisan support and veto proof supermajority.  The community honored President Cullerton at his family’s ancestral church St. Pius Church in Pilsen, and then bless Cullerton Street.</p>
<p>This past week the Highway safety legislation, SB 957, received historic bipartisan support by passing the Senate with an unprecedented 41 votes, or a supermajority of the Senate.  It now goes to the House for a vote in January and finally to Governor Pat Quinn’s desk for his signature. Governor Quinn has committed to signing the bill into law.  If passed, the legislation will go into effect 10 months after the governor’s signature.</p>
<p>&#8220;This historic legislation is helping countless of Latino families from being ripped apart,&#8221; said Father Brendan Curran of St. Pius Church.</p>
<p>Illinois is home to approximately 250,000 immigrant motorists who are unable to get a driver’s license and insurance.  Unlicensed and uninsured immigrant drivers cost Illinois residents $64 million in damage claims each year.  Last year 42% of all fatal crashes in Illinois involved unlicensed drivers, and nationwide, unlicensed motors are five times more likely to be in a fatal crash than licensed drivers.</p>
<p>The highway safety legislation is sensible and reasonable legislation to protect our highways and families, and will provide <em>$3.75 million</em> in new revenue, ease the burden on jails and courts, assist first responders and healthcare providers, and increase the pool of urgently needed organ donors.</p>
<p>The highway safety legislation was co-sponsored by Senate President John Cullerton and, in the House, by Assistant Majority Leader Edward Acevedo.  The legislation enjoys strong bipartisan support from political leaders:  Governor Pat Quinn, Former Governor Jim Edgar, Senate Minority Leader Christine Radogno, House Minority Leader Tom Cross, Chicago Mayor Rahm Emanuel, Comptroller Judy Baar Topinka, Attorney General Lisa Madigan, Cook County Board President Toni Preckwinkle, Cook County Clerk of the Circuit Court Dorothy Brown, Lake County Sheriff Mark Curran and Cook County Sheriff Tom Dart, among others, who endorse the legislation as a sensible solution to keep our highways safe and families secure.</p>

<p>We celebrate the genuine bipartisan support that SB 957 received to reach smart and sensible solutions to keep our roads and families safe.  It is encouraging to see both Democrats and Republicans working together to move past the immigration rhetoric to find concrete solutions that will benefit our immigrant families.</p>

<p>“Licensing and insuring all immigrant drivers will ease burden on jails and courts, which are currently drained by holding people solely for driving without a license or insurance,” said Lake County Sheriff Mark Curran.</p>
